The section contemplates that the offender must be in a state of intoxication. In such a state he must appear either in a public place or in a place where his presence would amount to trespass. There he must conduct himself in such a manner as to cause annoyance to any person. The offence under this section is a very simple one punishable with simple imprisonment only and that too for a maximum period of twenty-four hours only.
The section takes care of unbecoming behaviour of persons under influence of intoxication in public places or in places where the presence of the offender would amount to trespass. The offence under this section is non-cognizable, bailable and non-compoundable, and is triable by any magistrate.
